The Immigration Process

The following information may seem overwhelming but your Kelly Onboarding Specialist will assist you step by step with this rollercoaster ride, in order for us to get you here as soon as possible. So, hang in there! You will however, need to adhere to very strict deadlines in terms of getting all your documentation together, especially for the application of your work permit at the South African Embassy.

Departure is a balancing act. In other words, from the time your work permit is issued to the time that you are on your way to SA, could be a matter of days. So, in the meantime, make sure you have said your goodbyes to all your friends and family.

The documentation that you need to prepare for the Embassy is the following:

  • Signed Kelly Contract
  • Valid passport (must be valid for 3 months after your contract end date)
  • Police Clearance Certificate, translated into English OR an Affidavit in Lieu of Police Clearance Certificate (this only states that you have applied for the original certificate and will present it once you have the original document) this must be accompanied by a receipt to prove that you have applied for the police clearance.
  • A certified copy of your birth certificate (this must be translated into English) or an Affidavit (sworn declaration) stating that you have applied for the document and will present it once it is issued to you
  • Medical report
  • Radiology report
  • Vaccination Certificate – should you have been in a yellow fever area during the last year; you need to obtain a vaccination certificate from your local travel clinic.
  • BI 1738
  • Part P of the BI 1738
  • Airline tickets
  • Undertaking of Repatriation Letter from Kelly
  • Copy of Kelly Corporate Permits
  • Marriage or Divorce certificates (if applicable)

We will email or courier you provisional flight tickets and an original Corporate Workers Certificate. The Corporate Workers Authorisation Certificate and air tickets need to be submitted to the SA Embassy.

Please Note: This is not your actual work permit, the SA Embassy will stamp your work permit in your passport.

When you have all of the above documentation, then you are ready to lodge your application with the SA Embassy. 

12 Step’s to getting your work permit
Please see below the 12 step process that you will have to go through in order to get your work permit. Please follow each step exactly and in the order it is given, as it is in order of priority. Also, feel free to contact your Onboarding Specialist regularly to give him/her an update. 

Step 1
Read your contract thoroughly, sign it, scan it and return the signed contract to your Onboarding Specialist. You cannot take the next step until we have a signed contract of acceptance. Please provide your Onboarding Specialist with a physical address where he/she can courier the original documentation that you will require for your work permit application.

Step 2  
Please scan and email your Onboarding Specialist a copy of your passport, showing the photo and the expiry date.

Step 3
You need to apply for your police clearance. This requires a form from your government. The authorities will ask you for the employers stamp and signature. We do not supply this. This takes approx 2-4 weeks, so we need the RECEIPT OF APPLICATION OF POLICE CLEARANCE and an AFFIDAVIT IN LIEU OF POLICE CLEARANCE to submit to the SA Embassy. You must sign the affidavit and swear before a magistrate and get the magistrate's signature. The police clearance and affidavit for police clearance can be arranged at your local city hall.

Applying for a Police Clearance Certificate in the United States

Go to the local police precinct for finger printing and then follow the instructions on the FBI site www.fbi.gov

FBI clearance takes 3-4 weeks. However, as long as you have proof that you have submitted the application for the FBI clearance (a mail receipt or receipt of application), we can still proceed with the work permit application.

Step 4 
Obtain an original, long, English, (most are multilingual) copy of your birth certificate.

Step 5 
If you do not have a birth certificate and are not able to obtain one within a week, you may again have to do an affidavit with the magistrate (city hall) and submit your birth certificate at a later date (please note that you only have one year to submit it. If need be, perhaps you should do this on the same day that you do your police clearance affidavit).

Step 6 
Set up an appointment with your doctor to complete the following forms – a RADIOLOGY REPORT and a MEDICAL CERTIFICATE. Sometimes your house doctor is happy to do it, however in the Netherlands your house doctor might refer you to an “aarbeids” doctor. When you contact your family doctor explain that it is for immigration purposes. All the Embassy requires is the form signed and completed by the Doctor and Radiologist.

Please note that you may have to have chest X-Rays, but you don't have to send them through to us here in SA.

Step 7
Ensure you have a valid passport for three and a half years. (An ID/personal number from your country is not enough.)

Step 8
Follow the link and complete the document BI 1738. Remember to add a passport picture to the front page.

Step 9
Part P of the BI 1738 form will be couriered to you. Part P is the section completed by the employer and you add this section to the back of the BI 1738 forms that you have already completed.

Step 10
Kelly will courier the following to your physical address:

  • Original Corporate Workers Authorisation Certificate. (This is required by the Embassy for your work permit application.)
  • An Undertaking of Repatriation fees letter addressed to the South African Embassy.
  • Please wait for these documents before you make an appointment with the South African Embassy.

Step 11
Kelly will email you a provisional return airline ticket for your anticipated departure date. Please note the original ticket will only be issued after you have received your work permit from the SA Embassy & you have sent a copy to your Kelly Onboarding Specialist.

Step 12
You can now make an appointment with the South African Embassy to submit your documentation for your work permit.

You will be required to pay a fee of approximately 150-175 Euros for the administration costs. This will be reimbursed to you in South Africa. Please keep the receipt and give it to your Kelly Onboarding Specialist in South Africa, so that they can arrange for the amount to be reimbursed to you. This usually takes about one week to process.

For Suriname citizens you will need to have your documents couriered to the Jamaican Embassy, your agency that recruited you will be able to assist you with this.

American citizens that live far from the embassy can also courier their documents to the relevant Embassy. A +/- $16 money order should be included with your application to have your permit couriered back to you.

PLEASE NOTE: THESE COURIER FEES WILL BE FOR YOUR OWN COST.

Ideally you should schedule ALL this as soon as possible and with urgency, because the Embassy requires up to three weeks to process your work permit from the time you submit all the necessary documentation. Please supply copies of all this documentation within a week after you have signed your Kelly contract. If this is not possible, please call and tell us what the problems are so that we can manage arrival expectations with the company you will be working for.
 
The costs incurred for the medical, radiology and police clearance reports are for your own account. Kelly will cover the costs of your return flight (± €1500.00), AND attorney's fees (€850.00).

For all European Candidates you will need to pay the Administration fee of €160.00 to the consulate, this will be reimbursed to you once you arrive in SA.
